GABBI Terms of Use
These terms govern use of the GABBI desktop application, account dashboard, downloads and product support. They apply whether you buy as a consumer or for a business or professional practice; where the two differ, the difference is stated. Polar has separate buyer terms for checkout and payment services.
1. Parties and scope
The GABBI software and related product services are supplied by Vladimir Bakula, operating GABBI in France (“GABBI”, “we” or “us”). You are the individual practitioner or organisation accepting these terms (“you”).
GABBI is built for use in a trade, business, craft or profession. You may also buy as a consumer, meaning a natural person acting outside any trade, business, craft or profession. If you buy for an organisation, you confirm you have authority to bind it. Polar checkout includes an optional “I’m purchasing as a business” checkbox for business billing details. Consumer status depends on the purpose of the purchase, not solely on this checkbox or a tax identifier; selecting business billing is not itself a waiver of statutory rights. The GABBI Refund Policy explains withdrawal and refunds for consumer and professional purchases separately.
2. What GABBI provides
GABBI is an offline desktop documentation aid for practitioners. It can help draft and structure notes, but it does not replace professional judgment, clinical review or record-keeping duties. You remain responsible for reviewing, correcting and approving every output before relying on it.
The plan name, billing period, price and included entitlement shown at checkout form part of these terms. Product documentation and reasonable technical support are included; no uptime or response-time service level is promised for this soft launch.
3. Checkout, billing and taxes
Polar Software, Inc. acts as merchant of record and authorised reseller for purchases made through Polar Checkout. Polar processes payment, applicable transaction taxes, invoices and first-line transactional support under its own Checkout Buyer Terms and Privacy Policy. GABBI does not receive full card details.
The Monthly plan offers eligible first-time customers a 14-day trial after card validation: €0 at trial start, then €29 per month before applicable tax unless cancelled before the trial ends. All listed paid-plan prices and first-payment discounts exclude applicable tax. Polar shows the final total including applicable tax and the exact first charge date before you confirm checkout. Quarterly, annual and lifetime purchases have no trial. If you are ineligible for a trial, Polar may require immediate payment; review its final total and date before confirming.
Subscriptions renew for the period displayed at checkout until cancelled. Use the permanent “Cancel subscription / Résilier votre contrat” link at /en/cancel, also in the site footer, to access cancellation through the Polar customer portal. Complete and confirm cancellation in the portal; requesting its link alone does not cancel. Cancellation before the trial ends prevents the first charge; cancellation during a paid period stops future renewal and normally takes effect at the end of that paid period. It does not itself refund an elapsed period. The separate GABBI Refund Policy applies to refund requests.
4. Licence and account
Subject to a confirmed trial, payment or manually granted access and these terms, GABBI grants you a limited, non-exclusive, non-transferable licence to install and use the software for your own internal professional work during the entitlement period shown for your plan. An account alone does not allow a download. Your account and licence credentials must not be shared, sold or made public.
You may make a reasonable backup copy and exercise any rights that mandatory law does not allow these terms to restrict. Otherwise, you must not redistribute, rent, sublicense, bypass licence controls, or reverse engineer the software except where applicable law expressly permits it.
5. Clinical content stays offline
The desktop application is designed to process clinical notes, transcripts and related patient or client content locally on your device. That clinical content is not uploaded to the GABBI website, account database, Polar or the product Guide. You control the device, local files, access permissions, backups, deletion and any disclosure of that content.
Do not paste patient, client or other protected clinical content into the website, support email or GABBI Guide. The Guide is an online, product-only information service. Its automated refusal checks reduce accidental submission risk but cannot identify every kind of sensitive information.
6. Acceptable use
You must use GABBI lawfully and maintain appropriate professional, confidentiality and information-security safeguards. You must not:
- use the software as an autonomous diagnosis, treatment, emergency or risk-assessment system;
- upload malicious code, probe the website or evade account, entitlement or download controls;
- use another person’s account or misrepresent your professional status; or
- use GABBI in a way that infringes privacy, confidentiality, intellectual-property or other rights.
7. Ownership and feedback
GABBI and its licensors retain all rights in the software, website, models, branding and documentation. These terms grant a licence, not ownership. You retain rights in content you create or store locally. If you voluntarily provide product feedback, you allow us to use it without restriction or payment, without identifying you publicly unless you agree.
8. Updates, suspension and termination
We may update the software and these terms for security, legal or product reasons. Material changes apply prospectively and will be notified on the site or by account email where practical. Continuing a renewing subscription after the effective date constitutes acceptance; if you disagree, cancel before renewal.
We may suspend access for payment failure, fraud, security risk or material breach. Where the issue can be cured, we will normally give notice and a reasonable opportunity to cure. On expiry or termination, paid features and new downloads may stop. Existing local notes are intended to remain readable and exportable; keep independent backups and exports.
9. Warranties and liability
During the soft launch, GABBI is supplied on an as-available basis. We do not promise that generated drafts will be accurate, complete or suitable for a particular professional purpose. This does not exclude any express entitlement shown at checkout or any warranty that cannot lawfully be excluded.
To the extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, business, opportunity or data. GABBI’s aggregate liability arising from the product is limited to the amount paid for it in the 12 months before the event giving rise to the claim. These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of confidentiality or data-protection duties, or liability that law does not permit to be limited.
10. Governing law and contact
French law governs the supplier licence and product-service relationship, excluding conflict-of-law rules. Courts with jurisdiction at the supplier’s French domicile have exclusive jurisdiction between businesses, except where mandatory law requires another forum. Contact bakulavlad@gmail.com first so we can try to resolve a dispute promptly.
Polar’s Buyer Terms separately govern Polar Checkout, payment, invoicing and transactional disputes.
