GABBI Refund Policy

Polar is the merchant of record for GABBI purchases: you buy the product from Polar, and GABBI licenses it to you. That split decides who owes you what. Section 1 is the consumer right of withdrawal, which runs against Polar as seller. Section 2 is GABBI’s own policy for professional purchases. Section 5 is what any refund does to your licence and access.

1. Consumer purchases — 14-day right of withdrawal

If you buy as a consumer — a natural person acting outside any trade, business, craft or profession — you may withdraw within 14 calendar days of concluding the contract, without giving a reason and without penalty (articles L.221-18 to L.221-21 of the French Code de la consommation, implementing Directive 2011/83/EU). It covers every plan, including the one-time lifetime licence. Because the contract of sale is with Polar, this right runs against Polar as seller; GABBI is neither able to grant it nor to restrict it.

The download opens after a confirmed card-validated trial or paid entitlement. For a trial, the 14-calendar-day withdrawal period runs from conclusion of the contract at trial start, not from the later first payment. No waiver is requested by GABBI, and opening the download does not end that right: the withdrawal period remains available after downloading, installing and activating the software.

Send the withdrawal request to Polar, the seller, and copy bakulavlad@gmail.com from the purchase email with the Polar order number so the licence side (section 5) is recorded. Polar’s Checkout Buyer Terms govern the sale and are not restricted by this policy.

2. Professional purchases — refunds where we are at fault

If you buy for a therapy practice, company or other professional activity, the consumer withdrawal regime does not apply and there is no change-of-mind refund. GABBI is built for professional work, so this is the variant most purchases fall under.

A professional purchase is refunded where GABBI has not performed the contract: the paid product was not delivered, or it was materially non-conforming and we did not fix it within a reasonable time after you told us. Billing errors are corrected in every case — duplicate charges, and charges you did not authorise.

Send the request to bakulavlad@gmail.com with the Polar order number. Your statutory guarantees as a business buyer, and any mandatory remedy the law provides, are unaffected by this section.

3. Polar may refund at its own discretion

Polar is the merchant of record. It may refund a payment on its own initiative under its buyer terms, card-network rules or applicable law, independently of the two variants above. Neither this policy nor the CGV contracts that away; it is disclosed here so the possibility is visible.

4. Subscriptions and cancellation

You can cancel a subscription through /en/cancel (“Cancel subscription / Résilier votre contrat”) and the Polar customer portal. Confirm cancellation before your 14-day trial ends to prevent the first charge. Your confirmed trial end date and first-payment price before applicable tax are shown with your subscription; Polar confirms the final total including tax. Thereafter Monthly renews at €29/month before applicable tax unless cancelled. During a paid period, cancellation prevents the next renewal and access continues to the end of that period unless Polar or GABBI confirms otherwise. Cancellation and exercising a right of withdrawal are separate actions.

A refund request does not necessarily cancel a subscription. State clearly if you also want future renewals cancelled. A refund of a subscription payment and termination of the subscription are separate Polar operations.

5. What a refund does to your access

Approved refunds are initiated through Polar, not paid directly by GABBI. Polar determines payment-rail timing, automatically adjusts applicable tax and may apply its own fraud, card-network and legal checks. It may take several business days for the original payment method to show the credit.

A refund ends the paid entitlement behind the purchase, including a one-time lifetime entitlement. Everything that runs through your account stops: downloads, product updates, support, and any new or repeat activation of the licence. Once a refund is issued you receive no further updates.

There is no remote kill switch, and we would rather say so than imply one. The desktop application runs offline and never contacts us to check your licence, so a copy already installed and activated on your machine keeps working after a refund. The entitlement has ended even though nothing technically disables that build, and continued use of the licensed features is no longer permitted. On an offline product a refund is bounded by honesty, not by enforcement.

Your own records are never affected. Reading and exporting your existing notes and case files is permanent, does not depend on an active licence, and cannot be withdrawn — before or after a refund.

6. Which variant applies to you

Tell us which applies when you ask for a refund. A plain statement is enough; we do not ask for proof. Checkout does not put the question to you, so the refund request is where it gets recorded — and if you bought as a natural person and say nothing, we apply section 1, because a natural person is presumed to be a consumer unless the purchase was made for a professional activity. Where mandatory consumer law applies to you despite a professional purpose, it prevails over this policy, and nothing here restricts it.
